Texas 30.06 - 30.07 Explained

Texas Penal Code Sections 30.06 and 30.07 are the legal mechanisms that allow private property owners and businesses to prohibit individuals from carrying firearms onto their premises. These laws prohibit guns even if those individuals hold a valid License to Carry (LTC) or legally carry under Texas’s permitless carry (constitutional carry) law. 30.06 applies to concealed carry of handguns, while Section 30.07 applies to open carry of handguns.

For a restriction under these laws to be legally enforceable, the property owner must display specific, high contrast notices in both English and Spanish at all public entrances, featuring exact statutory wording in contrasting one inch letters, or provide personal verbal or written communication. Violating a properly posted 30.06 or 30.07 notice constitutes a Class C misdemeanor, which can be elevated to a Class A misdemeanor if the carrier was verbally informed by the owner or person in charge and refused to leave. Notably, these statutes do not apply to traditional residential properties, nor do they apply to certain federal, state, or municipal locations that are governed by separate statutory restrictions.
